On Kant's Marriage RightAlso on The Particularity and Importance of The Right of Humanity

  • Kant's legal right to marriage is a unique legal right in the theory of legal rights, which has long been underappreciated due to the fact that people tend to focus only on the shortcomings of its ethical orientation. In order to further develop the study of the specificity of Kant's juridical right to marriage, it is worth pondering why Kant takes "sexual relations" rather than "love" as the starting point of the law of marriage; it is also worth noting how Kant proves that the marital community is based on the right of humanity to reconstruct each other's personalities; and thus demonstrates the importance and specificity of the right of humanity represented by the right to marry, which not only clarifies the relationship between right and morality, but also facilitates the advancement of private law to public law.
