Normative Dilemmas and Response Options for Rural Domestic Energy Provision in the Context of Energy Justice

  • As China's rural revitalisation strategy continues to advance, safeguarding energy for rural life should receive renewed legal attention. A review of China's current legal norms for safeguarding energy for rural life reveals that there are many problems, such as the incomplete construction of the legal system, the simplistic provisions of the institutional text, and the lack of clarity in the articulation of administrative powers. From a holistic perspective, exploring the logic of the rule of law is the basis for improving legal norms. The legal construction of rural energy security should be based on the theoretical kernel of energy justice. With the right to rural energy as the logical starting point for the formulation of legal norms, cooperation and compromise with the environmental rights should be achieved at the current stage. And in rural areas the two sequences should be determined on the basis of typological differentiation. In the process of normative improvement the priority of the legislative theory model should be upheld, and the moderated legislative operation method taken. Specific solutions need to be implemented both at the level of implementing the concept of energy justice as a whole and at the level of formulating specific rules.
