Systematization and De-technology: The Teleology of Codification ofChina's Environmental Code

  • Marxist philosophy emphasizes that the purpose has initiative, and it is precisely because the purpose has the initiative that the main activity has directionality, so the purpose of the environmental code codification reflects the expected results of the environmental code. Looking back at the history of codification worldwide, the study of the teleology of codification has always been a fundamental position and has received extensive attention. Enriching the connotation of the teleology of environmental law codification is an inevitable choice to improve the theoretical foundation of China's environmental code. The purpose of incorporating de-technology into the codification of the environmental code directly faces the contradiction between the demand for openness of environmental law and the stability of the code, which is beneficial to solving the pain points of the monistic teleology of environmental code codification, helping to better prove the necessity of environmental code codification, and to explore the optimal plan for the formulation of environmental codes.
