The Systematic Structure of Climate Change Legislation under the Holistic System View

  • Addressing climate change is a complex and systematic project. Using legislative means to address climate change is the era mission of the socialist legal system with Chinese characteristics. As a political proposal, the holistic system view provides a basic direction for the realization of climate change legislation from formal systematization to substantive systematization. The substantive systematization of climate change legislation is associated with the systematic construction of "legal value - legal framework - legal system". First, a multi-level legislative objective that coordinates with the ecological environment should be built in terms of the value of climate change law. Second, a three-dimensional plan guided by the basic law, supported by the relevant law and guaranteed by the peripheral law should be created in terms of the framework of climate change law. Last, the legal system can be classified into three modules: risk prevention, process control and damage relief in terms of the system of climate change law.
