Research on the Relationship Between Weibo Public Opinion and Judicial Trial from the Perspective of Field

  • With the establishment of socialist rule of law state, people’s concept of democracy and rule of law has been enhanced, and the justice or otherwise of judicial trial has become the value pursuit of the general public.In addition, with the wide popularity of modern Internet services, the power of microblogging public opinion to supervise judicial practice has become increasingly prominent, but there is also a negative impact on the independence and impartiality of judicial trial to a certain extent, thus leading to contradictions and even imbalance between the two. This paper inquires ways to solve the problem of imbalance between microblogging public opinion and judicial trial, and to give effective measures to balance the two from dimensions of theory and practice. Taking Bourdieu’s “field theory” as a logical starting point, we analyze which actors exist in the microblogging field and the trial field, what habits and capital they have, and the relationship between the microblogging field and the trial field when the microblogging field has intermediary characteristics. Through analyzing typical cases that have caused great reactions on microblogs, we deduce that the balance point of the two fields is to keep the total amount of capital in the trial field and the microblog field equal, and propose corresponding measures to improve them, so as to help optimize the interaction between microblog public opinion and judicial trials.
