Reflections on the "Condition Maturity Theory" of Environmental Law Codification

Abstract
As the final form of law, the codification process must be careful, and meet conditions for codification including internal and external conditions, which should have been achieved before the beginning of the codex movement. Most scholars support the codification and think that the conditions of environmental law codification in our country are indeed mature, and we should start the legalization movement of environmental law as soon as possible, but most of them can change the current situation of environmental law confusion and contradiction in our country and what kind of model the environmental law should choose, but neglect what kind of internal and external conditions are sufficient to support the legalization movement of environmental law. In the rare research, Professor Fu Lixia analyzes what kind of conditions should be met in the codification from both subjective and objective aspects, which generally include political conditions, economic conditions, historical traditions, etc., while subjective aspects are the requirements of the law itself. Through the analysis of the development of China's environmental law, it will take time to test whether the conditions of environmental law codification are really mature.
