  • 摘要: 中国积极推进生物多样性保护法制化进程,努力通过公益诉讼为生物多样性保护提供法治保障,在生物多样性保护公益诉讼的立法和司法实践上积极作为,成效显著,有力推动了生物多样性保护工作,促进了生态环境的可持续发展。但由于起步较晚,经验积累不充分,此项公益诉讼目前在运行中也面临一些困难和问题,需要探寻可行的路径予以克服。可选择如下路径来优化生物多样性保护公益诉讼制度:第一,扩大诉讼的主体资格范围,通过解除注册方面的限制,放宽从业年限的要求,让更多的社会组织获得提起诉讼的原告资格,未来时机成熟时还准许公民个人提起诉讼。第二,通过完善立法、发布指导性案例、拓展预防性诉讼案件的线索来源等途径,大力促进预防性诉讼。第三,多途径解决诉讼资金短缺问题,如建立专项基金制度、胜诉奖励制度和完善诉讼费用制度,为社会组织广泛开展生物多样性保护公益诉讼提供基本的资金保障。第四,完善法律责任承担判定的规则,适当扩张责任承担的主体范围,并在受损生态环境修复责任承担的判定上作出一些更为合理、公正的原则性要求。

     

    Abstract: This study, which employs a literature review, fact-finding, data analysis, and case studies as its main methods, concludes that China has actively promoted the legalization of biodiversity conservation, endeavored to provide legal guarantees for biodiversity conservation through public interest litigation, and made proactive efforts in legislation and judicial practice of public interest litigation for biodiversity conservation. It also finds that China's remarkable achievements have promoted biodiversity conservation and the sustainable development of the ecological environment. As a late starter, China lacks sufficient experience and faces some difficulties in public interest litigation. Therefore, it is necessary to explore feasible solutions, and the study recommends four paths to optimize public interest litigation for biodiversity conservation, aiming to promote the sustainable development of the ecological environment. First, the scope of plaintiff qualification should be expanded. Second, preventive litigation should be vigorously promoted by improving legislation, issuing guiding cases, and expanding the sources of clues in preventive litigation. Third, several ways should be found to reduce the shortage of litigation funds and provide basic financial guarantees for social organizations to carry out extensive public interest litigation for biodiversity conservation. Fourth, the rules for the determination of legal liability should be improved. More reasonable, fair principles should be adopted to determine liabilities for the restoration of a damaged ecological environment.
