Theoretical reflection and codex approach of watershed governance legislation under the theory of human and nature isomorphism

  • 摘要: 我国虽然基本形成较为完备的流域治理法律体系,但以《水法》为核心的《水污染防治法》、《防洪法》、《水土保持法》等流域治理立法仍延续“条块”结合治理,水资源、水环境和水生态分治的思维模式,造成实践中流域治理梗阻。究其根源,学理层面,现行流域治理立法“条块”结合治理、水资源、水环境与水生态分治违背流域整体性、系统性和联系性规律。法理层面,流域治理立法“条块”结合治理和水资源、水环境与水生态分治既不符合科学立法原则,又违背法秩序统一性原理,规范重复、冲突更影响规范效力和位阶秩序。有鉴于此,我国应加快推进《环境法典》编撰,遵循整体治理、系统治理和统筹治理思路,综合采用立改废释等技术推进流域治理规范在《环境法典》污染防治编和自然保护编中优化、融贯和协调,形成具有中国特色的流域治理法律体系。与此同时,在法典尚未出台或暂不成熟的情况下,立法也应采取多元手段优化现行流域治理规范,为法典化过渡时期纷繁复杂的流域治理问题提供规则依据。

     

    Abstract: Although China has basically formed a relatively complete legal system for watershed management, the watershed management legislation such as the Water Pollution Prevention and Control Law, Flood Prevention Law and Soil and Water Conservation Law, with the Water Law as the core, still continues the thinking mode of combining "strip and block" management and separating water resources, water environment and water ecology, resulting in the obstruction of watershed management in practice. To investigate the root cause, at the academic level, the current legislation of watershed governance "strip" combined governance, water resources, water environment and water ecology separation violates the law of integrity, systematism and association of watershed. At the legal level, the combination of "strip" and the separation of water resources, water environment and water ecology in watershed governance legislation is not in line with the principle of scientific legislation, but also violates the principle of unity of legal order, and the regulation duplication and conflict affect the regulation effectiveness and ranking order. In view of this, China should speed up the compilation of the Environmental Code, follow the ideas of overall governance, systematic governance and overall governance, and comprehensively adopt technologies such as legislation, reform and waste release to promote the optimization, integration and coordination of watershed governance norms in the pollution prevention and protection compilation of the Environmental Code, so as to form a legal system of watershed governance with Chinese characteristics. At the same time, in the case that the code has not been issued or is not mature, the legislation should also adopt multiple means to optimize the current watershed governance norms, so as to provide rules basis for the complicated watershed governance issues in the codification transition period.
