Abstract: As the profound impact of aging society becomes increasingly prominent, the burden and risk of family care are increasing. Under the traditional family care model, the rights and interests of family members such as children and the elderly in need of care cannot be protected, and family members such as parents with the responsibility cannot achieve a balance between work and family. Based on the analysis of international law and the Constitution, the family's right to social protection is inalienable. The government's sharing of family care responsibilities should be regarded as a government's basic responsibility and as a government's commitment to human dignity. Human dignity should become an important criterion for the government to take care of the family. The government can comprehensively use the positive rights approach, the negative rights approach, and the expressive approach to realize the shared responsibility of the government and the family.
