Abstract:
The negative list management model has gradually replaced the positive list and has been well developed in developed countries. Affected by the open economic policy, there is no special negative list at the domestic level in Germany. Investment and trade prohibition or restrictive provisions are scattered in domestic legislation. At the international level, after the Lisbon Treaty entered into force, the EU has completed the transition from a positive list to a negative list. Germany has developed a comprehensive negative list in bilateral international agreements. In recent years, China's related documents related to negative lists have been continuously issued, but there are still problems such as excessively long lists, incomplete systems, and incomplete negative lists in bilateral international agreements. Through the study of German negative lists, we can learn from their experiences and expand China's openness Reduce the list, reduce the frequency of revision of our negative list, formulate our negative list in the field of import trade and promote the formation of our negative list template at the level of international law, and promote the development of our negative list.
