中国非商业代孕的有限治理:行动路径与制度设计

Limited Governance of Non-Commercial Surrogacy in China: Action Pathways and Institutional Design

  • 摘要: 代孕在当代中国引发持续的伦理、法律与政策争论。现行立法坚持全面禁止,但在现实层面,非商业代孕的需求与实践并未消失,且在生育率下降、个体生殖困境与跨境医疗便利的推动下呈增长态势。全面禁止与社会需求之间的张力,使代孕治理陷入“无法消除、不得承认、难以治理”的困境。本文在公共管理与风险治理的分析框架下提出“可治理性”转向,超越伦理僵局与单一否定立场,讨论在中国社会条件下如何将非商业代孕纳入治理。文章从目标、约束、工具、能力、结果五个维度展开,主张以有限度、渐进式与高约束的制度化设计,在省级层面回应社会关切的同时控制风险扩散。结合国际经验与本土制度逻辑,提出以省为单位、聚焦医学需求的非商业代孕的可治理但不泛化的中间路径。

     

    Abstract: Surrogacy in contemporary China has triggered ongoing ethical, legal, and policy debates. Existing legislation adheres to a complete prohibition, but at the practical level, the demand and practice of non-commercial surrogacy have not vanished, and are exhibiting a growing trend driven by declining fertility rates, individual reproductive dilemmas, and the convenience of cross-border medical services. The tension between the complete prohibition and social demand has plunged surrogacy governance into a predicament of "cannot be eliminated, cannot be acknowledged, difficult to govern." This article proposes a "governability" shift under the analytical framework of public management and risk governance, transcending ethical impasses and singular negative stances, and discusses how to incorporate non-commercial surrogacy into governance under Chinese social conditions. The article unfolds across five dimensions: objectives, constraints, tools, capabilities, and outcomes, advocating for a limited, gradual, and highly constrained institutional design that addresses social concerns at the provincial level while controlling the diffusion of risks. Drawing on international experiences and local institutional logic, it proposes an intermediate path of governable but non-generalized non-commercial surrogacy, with provinces as the unit and a focus on medical needs.
